Terms of Service — Keep Trade Cut

These Terms of Service ("Terms") govern your use of the Keep Trade Cut mobile application ("App") operated by Bo the Chow Studios LLC ("we," "us," or "our").

By using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Description of Service

Keep Trade Cut is a fantasy sports ranking app where users vote on player comparisons (Keep, Trade, or Cut) across MLB, NFL, NBA, and NHL. Community votes determine ELO-based player rankings.

2. Account Registration

  • You must create an account to use the App (via email, Apple Sign In, or Google Sign In)

  • You are responsible for maintaining the security of your account credentials

  • You must be at least 13 years old to create an account

  • One account per person

  • You agree to provide accurate information during registration

    Premium Subscription


  • Monthly: Billed monthly at the current price shown in the App

  • Yearly: Billed annually at the current price shown in the App (savings compared to monthly)

  • Free Trial: New subscribers may be eligible for a 7-day free trial

  • Payment will be charged to your Apple ID account at confirmation of purchase

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of the selected plan

  • You can manage and cancel subscriptions in your Apple ID Account Settings

  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

  • You may cancel at any time through your Apple ID Account Settings

  • Cancellation takes effect at the end of the current billing period — you retain access until then

  • No refunds are provided for partial billing periods

  • Refund requests for purchases are handled by Apple per their refund policy

    • 4. Free Tier vs Premium

    Free users have access to:

  • Keep/Trade/Cut voting across all 4 sports

  • Top 10 leaderboard preview

  • Ad-supported experience (interstitial ads between voting sessions)

    • Premium users additionally get:

  • Full leaderboard access

  • Ad-free experience

    • 5. Acceptable Use

    You agree NOT to:

  • Use bots, scripts, or automated tools to vote or access the API

  • Attempt to manipulate player rankings through fraudulent voting

  • Circumvent rate limits or security measures

  • Reverse engineer, decompile, or disassemble the App or API

  • Use the App for any unlawful purpose

  • Create multiple accounts to inflate or manipulate rankings

  • Scrape or harvest data from the App

    • Violation of these terms may result in immediate account suspension or termination without notice. We reserve the right to remove fraudulent votes and adjust rankings accordingly.

    6. Intellectual Property

  • Player statistics are sourced from publicly available ESPN APIs

  • Player headshots are served from ESPN's CDN

  • The App's design, code, ELO ranking system, and user interface are proprietary to Bo the Chow Studios LLC

  • "Keep Trade Cut" is a trademark of Bo the Chow Studios LLC

  • You retain no intellectual property rights in your votes, which become part of the anonymous community dataset

    • 7. Disclaimers

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    Without limiting the foregoing:

  • Player rankings are community-driven opinions and do not constitute professional fantasy sports advice

  • We do not guarantee the accuracy, completeness, or timeliness of player statistics (sourced from ESPN)

  • Service may be interrupted for maintenance, updates, or circumstances beyond our control

  • We are not responsible for the content, accuracy, or availability of third-party services (ESPN, Apple, Google, Firebase)

    • 8. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, BO THE CHOW STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

    OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

    9. Account Deletion

  • You may delete your account at any time via Settings > Delete Account

  • Email-registered users must re-enter their password to confirm deletion

  • Deleted accounts enter a 30-day grace period (you can recover by contacting us during this time)

  • After 30 days, your account and personal data are permanently removed

  • Anonymized voting data is retained for community rankings and cannot be attributed to you

    • 10. Dispute Resolution

    Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You agree that any arbitration will be conducted on an individual basis and not as a class action or other representative proceeding. The arbitration shall take place in the State of Ohio.

    You may opt out of this arbitration clause by sending written notice to help@bothechowstudios.com within 30 days of first accepting these Terms.

    Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction for claims related to intellectual property or data security.

    11. Changes to Terms

    We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify users via an in-app notice. Your continued use of the App after changes constitutes acceptance of the updated Terms.

    12. Severability

    If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.

    13. EULA

    Your use of the App is also governed by Apple's Standard End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

    14. Governing Law

    These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Ohio.
